Criminal Law Reform
What has become patently obvious, is a need for radical criminal law reform. For far too long, we have seen sentences being handed down for serious crime, which are an insult to the victims and the country. We have witnessed for far too long, serious divergences in sentencing. We now demand a radical overhaul of Criminal Law and Sentencing as a minimum, in the following areas.
Abolition of concurrent sentencing.
Murder of a member of an Gardá Siochána, Ambulance & Fire personnel and Military while on duty - 40 year mandatory sentence in addition to 1 year for each year of the victim's life, without parole. The sentence to run consecutively.
Single Murders - Mandatory sentencing of 1 year for each year of the victim's life, without Parole, in addition to a 10 year mandatory sentence for murder, to run consecutively. Once the initial sentence has been served, Parole may be considered during the mandatory 10 year period.
Multiple Murders - Mandatory sentencing of 1 year for each year of each victim's life, without Parole, in addition to a 10 year mandatory sentence for murder, to run consecutively. Once the initial sentence has been served, Parole may be considered during the mandatory 10 year period.
Rape, Incest & Child abuse - Mandatory sentencing of 1 year for each year of the victims life without Parole, in addition to a 10 year mandatory sentence to run consecutively. Once the initial sentence has been served, Parole may be considered during the mandatory 10 year period.
Driving under the influence of alcohol/drugs.
Dangerous driving causing death:
Mandatory sentence of 1 year for each year of each victim's life to run consecutively, with Parole after a minimum of 10 years. Driving ban for life.
Driving while using a mobile phone:
We are waiting for drafting of suggestions in relation to Political and Banking criminal legislation.

- 3rd offence - a mandatory sentence not exceeding 12 months imprisonment without Parole; a 5 year driving ban; a requirement to re-sit driving test, plus €5,000 fine.
- 4th offence - a mandatory sentence not exceeding 2 years imprisonment without Parole, a lifetime ban, plus €10,000 fine.
- Where death has occurred in any of the four categories, a consecutive sentence of 1 year, for each year of each victim's life.
